Terms of Service
Takebase is a mobile app for a band to keep its recordings in one place: share a take in, drop a comment at a timecode, stack a new take on top of the old one. These terms are the agreement between you and the person who makes it.
Who you are agreeing with
Takebase is made and operated by Tanel Teemusk (trading as Massruum), Estonia. Where these terms say we or us, that is who they mean. You can reach a human at hello@teemusk.com.
Your account
You need an account to use Takebase, and you can create one with an email address and password, with Google, or with Apple. You are responsible for what happens under your account, so keep the credentials to yourself. You must be at least 13 years old, or older if the law where you live sets a higher age for agreeing to something like this.
If you want your account and everything in it removed, write to the address above and it will be deleted.
Your recordings stay yours
Everything you put into Takebase - audio, song and album names, artwork, comments - remains yours. We claim no ownership of it and we do not licence it to anybody, use it to train anything, or listen to it for any purpose other than making the app work and, if you ask us to, helping you with a problem.
What you do give us is the narrow permission the app cannot run without: to store your files, to move them between your device and our storage provider, to produce the playable version and the waveform the app draws, and to serve them to the people you have shared them with. That permission ends when you delete the content.
What you upload
Upload only recordings you have the right to upload. Do not use Takebase for anything unlawful, for material you have no licence to, or to distribute somebody else's music as if it were yours. We do not screen what you upload, but we will remove content and close accounts if we are given good reason to.
Albums, members and share links
An album is the unit you invite people to. Anyone you invite can hear everything in it, comment on it and add takes to it. The person who created the album can also delete it, which deletes everything in it. Choose who you invite accordingly.
A share link is an invitation to an album rather than a page that plays anything. Anyone holding it can open it, install Takebase, sign in and join the album, and from then on they are a member like any other. The token in the link is long and random, so it will not be guessed, but it is not a password: treat a share link as something that can be forwarded, because it can. A link stops working 24 hours after it is created, and you can remove a member from an album at any moment, which takes effect immediately.
Storage allowance and subscriptions
Every account gets an allowance measured in recorded minutes. The albums you own are charged to your allowance; an album somebody else shares with you costs you nothing.
A paid plan raises that allowance. Paid plans are sold and billed by Apple's App Store or Google Play, not by us, so the price you see, the renewal, the payment method and any refund are handled under their terms and managed in your Apple or Google account. A subscription renews until you cancel it there. Cancelling stops the next charge; it does not delete anything you have already uploaded.
A free trial, where one is offered, becomes a paid subscription unless you cancel it. The App Store shows the length of the trial and the price that follows it before you confirm, and the app shows the same two facts on the screen you start it from. Payment is taken at the end of the trial period unless you cancel at least 24 hours before it ends, and the subscription then renews at that price until you cancel. A trial is offered once per Apple ID; cancel or manage it in your Apple account's subscription settings.
Going over your allowance pauses the app, and nothing is deleted. While an account is over its limit it cannot upload anything new, and playback stops for everything on it - your recordings are all still there, and they play again the moment you are back under the limit, either by deleting something or by subscribing.
Availability, and the part nobody likes reading
Takebase is provided as it is. We work to keep it up and to keep your files intact, and there is a daily backup of the metadata, but we cannot promise the service will never be unavailable, never lose data, or never change. Keep your own master copies of anything you care about. Takebase is a place for a band to work, not an archive of record.
To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to what you have paid us in the twelve months before the claim.
Ending it
You can stop using Takebase and delete your account whenever you like. We can suspend or close an account that breaks these terms, or stop offering the service - with reasonable notice, and with a chance to get your files out, unless the reason makes that impossible.
Accounts nobody opens
Audio costs money to store every month, so an account that has been abandoned does not sit on our servers indefinitely. This applies to free accounts only - an account with an active subscription is never removed this way.
If you have not opened the app for five months, we email the address on the account to say so. If six months pass from the last time you used it, the account is deleted along with the albums you own and everything in them: songs, takes, comments, artwork and share links. That deletion is permanent and we cannot undo it.
Opening the app is all it takes to stop this, and it resets the clock. You will always have had at least three weeks' notice by email before anything is deleted; if we cannot reach you by email, nothing is deleted at all.
Changes
If these terms change in a way that matters, the app will tell you before the change takes effect. The date at the top says when this version was written.
Law
These terms are governed by Estonian law, and the courts of Estonia are where a dispute would be heard. Nothing here takes away a consumer right you have under the law of the country you live in.
